Could I successfully file a personal injury lawsuit if I hired a attorney?

I was in a car accident 3 months ago. At the scene I didn't realize that I had had whip-lash and hairline fracture to my right arm so I said I am fine and didn't ask for an ambulance. I have been seeing a chiropracor since. Can I still get personal injrury money eventhough 3 months have passed and I haven't filed anything against him yet?

Yes. If you have a sufficient injury then you can sue. The time it took for the injury to manifest itself is just one of many factors that will be considered.

While no one can assure "success", from the information given you do have a right to file suit. It is common that immediately after an accident, an injured person feels no pain due to the excitement of the moment. If the fracture is confirmed by x-ray and caused by the accident, that qualifies as a "serious injury". The statute of limitations is three years.

Yes. The statute of limitations is 3 years. Did you file for no-fault with your carrier to cover your medical bills/lost wages? In a car accident case, you need to prove you suffered a "serious injury" as defined by law and a fracture qualifies so you can recover for all your injuries. I am a former federal and State prosecutor and have been handling accident cases since 1996 so please feel free to check out my web site and contact me if you wish to retain counsel.
