How much of the payout should a personal injury attorney get?

I had a car accident and my lawyer wants 33.3% of what the insurance company gives and she says that is how much she is supposed to be getting. Isn't that a liitle bit too much? I thought the limit was 30%.

She's correct, but the retainer you signed determines it all. For your information, the Courts have set the limit for how much can be charged by all attorneys and that is set at 33% in NY. Good luck.

Your attorney is correct. Its 1/3 in New York. In other states its even higher.
